A variety of serious personal injuries and death can occur as a result of car accidents. Most injuries occur as a result of the impact of slamming into part of the vehicle that collides with another vehicle or object, or as a result of being hit by unsecured cargo that becomes airborne in a crash.
While a defendant’s conduct might be considered questionable, it may not give rise to damages in a personal injury case. So if a plaintiff knowingly and willfully chooses to encounter a known hazard, the law provides that he or she has assumed the risk of injury.
